By creating an account, enrolling in a course, or otherwise using the Site, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) and that you agree to these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Site or purchase any course.

All course purchases are final. We do not offer refunds, exchanges, or credits for any reason once a purchase is completed and course access has been granted. This includes, without limitation, cases where you:

• Change your mind after purchase;
• Did not use or access the purchased course;
• Experienced technical difficulties unrelated to our platform;
• Purchased the course by mistake.

Before purchasing, we encourage you to review all available free previews, the FAQ, and to contact us with any questions at support@twistlabco.com.

Upon successful payment, you receive a non-transferable, non-exclusive, personal license to access the purchased course content for your own personal, non-commercial use. Course access is provided “as-is” and is subject to availability. We reserve the right to modify, update, or discontinue course content at any time without notice.

To access purchased courses you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete registration information;
• Promptly update your information to keep it accurate;
• Notify us immediately at support@twistlabco.com of any unauthorized use of your account;
• Not share your account credentials with any third party.

We reserve the right to suspend or terminate your account at our sole discretion, including if we believe you have violated these Terms, without prior notice or liability, and without refund.

You agree not to:

• Copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any course content for any commercial purpose without our express written consent;
• Screen-record, download, or otherwise capture course video content in any format;
• Share your account login or allow others to access course content through your account;
• Use the Site or course content for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
• Attempt to gain unauthorized access to any part of the Site, server, or any system connected to the Site;
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm us or other users;
• Use any robot, spider, scraper, or other automated means to access the Site for any purpose.

Violation of this section may result in immediate termination of your access without refund and may expose you to civil or criminal liability.

All content on the Site — including but not limited to course videos, written materials, images, graphics, logos, trademarks, and the “TwistLab” name — is owned by or licensed to TwistLab and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

You are granted a limited, revocable, non-exclusive, non-transferable license solely to access course content for personal, non-commercial use during the term of your enrollment. All other rights are expressly reserved.

All prices are displayed in U.S. dollars (USD) and are subject to change at any time without notice. Prices shown at the time of checkout are final for that transaction. We use Stripe as our payment processor. By completing a purchase, you also agree to Stripe's terms of service. We do not store your full payment card details on our servers.

Promotional or discounted prices are limited-time offers and may expire at any time. Completing a purchase at a promotional price does not guarantee future purchases at the same price.

The Site and all course content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

No guarantee of success. TwistLab makes no representation, warranty, or guarantee that any student will achieve particular results, outcomes, skill levels, income, bookings, or career success as a result of purchasing or completing any course. Success depends entirely on a wide range of factors that are outside our control, including but not limited to:

• The student's personal effort, dedication, and consistency of practice;
• Prior experience, background knowledge, and natural aptitude;
• Geographic location and local market demand for balloon entertainment;
• Local competition and pricing dynamics in the student's area;
• Personal business decisions, marketing efforts, and networking;
• Economic conditions and other external circumstances beyond anyone's control.

Any testimonials, earnings figures, or student stories displayed on the Site reflect individual experiences and are not typical results. They are provided for illustrative purposes only and should not be interpreted as a promise or guarantee of what you will achieve. Your results will vary and depend on many factors unique to your own situation.

By purchasing a course, you acknowledge and agree that TwistLab has made no promises, representations, or warranties regarding your potential outcomes, and that you are solely responsible for your own decisions, actions, and results.

To the fullest extent permitted by applicable law, TwistLab, its officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of (or inability to use) the Site or course content, even if advised of the possibility of such damages.

In no event shall our total aggregate liability to you exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or $100 USD, whichever is greater.

You agree to defend, indemnify, and hold harmless TwistLaband its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

The Site may contain links to third-party websites, services, or content. These links are provided for convenience only. We do not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party sites. Your interactions with third-party sites are solely between you and that third party.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Site after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

We may suspend or terminate your access to the Site and any purchased courses, with or without cause, with or without notice, at our sole discretion. Upon termination, all licenses granted to you will immediately cease. No refund will be issued upon termination for cause (i.e., violation of these Terms).

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration conducted in English, with proceedings conducted in the United States, under rules mutually agreed upon by the parties or under the American Arbitration Association Commercial Arbitration Rules. You waive any right to participate in a class action.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TwistLab with respect to your use of the Site and supersede all prior agreements and understandings.
